We built Emberly to help you put down the phone and pick up something real. That philosophy extends to your data — we collect only what we need to get your kit to your door, protect your order from fraud, and make your experience better. No tricks, no dark patterns, no selling your information. This policy explains exactly what we collect, why, how long we keep it, and what you can do about it.
WHAT WE COLLECT
We collect two types of information.
When you browse our site, we automatically collect basic device and browsing information: your IP address, browser type, device type, time zone, referring site, and which pages you visit. We use cookies, log files, and tracking pixels to gather this. We call this "Device Information." Some of this data — particularly your IP address and device fingerprint — is also used to verify the legitimacy of orders and to investigate suspected fraud.
When you place an order, we collect the information needed to fulfill it: your name, billing and shipping address,payment details (processed securely through Shopify Payments, PayPal, Shop Pay, Apple Pay, and Google Pay — we never see or store your full card number), email address, and phone number. We call this "Order Information." We also retain a record of your IP address and device at the time of purchase, your order confirmation, all communications you have with us, and any tracking and delivery confirmation we receive from the carrier.
HOW WE USE YOUR INFORMATION
We use your Order Information to:
- Process and fulfill your order (payment, shipping, confirmations, tracking, and delivery updates)
- Communicate with you about your order or answer your questions
- Screen orders for fraud and verify the identity of the cardholder
- Resolve returns, refunds, customer service requests, and payment disputes
- Send you product updates or offers — only if you have opted in, and you can unsubscribe anytime
We use your Device Information to:
- Improve our website and understand how customers find and use it
- Measure the effectiveness of our advertising, so we can show our ads to people who are genuinely interested rather than wasting your feed with irrelevant content
- Detect fraud, abuse, and security threats
ORDER VERIFICATION AND FRAUD PREVENTION
Every order placed on myemberly.com is automatically screened for fraud signals — including Address Verification Service (AVS) checks, billing-to-shipping address comparison, IP geolocation, device fingerprinting, and order history. Orders that don't pass these checks may be held for manual review, require additional verification, or be canceled and refunded in full. We reserve the right to refuse or cancel any order we believe to be fraudulent or placed without the cardholder's authorization. This protects you, the legitimate cardholder, and us.
TRANSACTIONAL EMAILS
When you place an order, you'll automatically receive transactional emails from us: order confirmation, shipping confirmation with tracking, delivery notifications, and any messages we need to send about your specific order (such as a delay, a refund, or a replacement). These are not marketing emails — they're part of the service you paid for, and you can't unsubscribe from them while your order is active. Once your order is complete, you can opt out of any non-essential follow-up by clicking unsubscribe at the bottom of any marketing email, or by contacting us directly.
WHO WE SHARE IT WITH
We share your information only with the service providers that help us run the store and fulfill your orders:
- Shopify powers our online store and processes transactions
- Our shipping and fulfillment partners receive your name and address to deliver your order
- Google Analytics helps us understand how customers interact with our site
- Meta (Facebook and Instagram) receives data to help us measure ad performance and reach people similar to our customers
- Our email service provider sends order confirmations and marketing emails on our behalf
We do not sell your personal information. Period.
We may also share information if required by law — for example, in response to a subpoena, court order, or government request — or to protect our rights, your safety, or the safety of others.
PAYMENT DISPUTES AND CHARGEBACKS
If a payment dispute or chargeback is filed against an order, we retain and may share relevant order information — including the IP address and device used to place the order, the billing and shipping addresses, the AVS result, all communications with us, the shipping confirmation, the carrier tracking record, and the delivery confirmation — with the customer's bank, the card network (Visa, Mastercard, American Express, Discover), our payment processor, and any other party necessary to resolve the dispute. By placing an order, you acknowledge that this information may be shared for that purpose. If you believe a charge is incorrect or unauthorized, please contact us at support@myemberly.com before filing a dispute with your bank — we resolve almost every issue within 48 hours, and our 90-day money-back guarantee means a refund is always faster than a chargeback.
ADVERTISING AND YOUR CHOICES
Because we acquire most of our customers through Facebook and Instagram ads, we use tracking pixels to understand which ads are working. This means Meta may use information about your visit to show you Emberly ads on their platforms and on other sites.
You can opt out of personalized advertising at any time:

DO NOT TRACK
We do not currently alter our data collection practices in response to "Do Not Track" browser signals, as there is no consistent industry standard for how to respond to these signals.
YOUR RIGHTS
If you are a U.S. resident, you can contact us at any time to request access to the personal information we hold about you, ask us to correct it, or request that we delete it.
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), gives you specific rights:
- The right to know what personal information we collect, use, and disclose
- The right to correct inaccurate personal information
- The right to delete personal information we have collected from you
- The right to limit our use of sensitive personal information
- The right to opt out of the sale or sharing of personal information (as stated above, we do not sell)
- The right to non-discrimination for exercising any of these rights
If you are a European resident, you have the right to access, correct, update, or delete your personal information under GDPR. We process your data to fulfill orders (contractual basis) and to pursue our legitimate business interests as described above.
To exercise any of these rights, contact us at support@myemberly.com. Before we release, change, or delete any information, we will verify your identity by matching your request to the name, email, and billing details on your original order. This step protects you from someone else attempting to access or alter your account. If we cannot verify the request, we will deny it.
DATA RETENTION
We retain Order Information for a minimum of seven (7) years from the date of purchase. This is required to comply with U.S. tax law, to handle returns and refunds under our 90-day guarantee, to resolve any payment disputes or chargebacks, and to maintain accurate business records. We retain marketing data (such as your email subscription) until you unsubscribe or request deletion. Device Information used for analytics is typically retained for 26 months. Where you have asked us to delete your information, we will do so unless we are legally required to retain it for the purposes above, in which case we will explain that to you.
SECURITY
Your payment information is processed through Shopify's PCI-compliant payment infrastructure. We use SSL encryption across our entire site. While no method of electronic transmission is 100% secure, we take reasonable measures to protect your personal information.
COOKIES
We use cookies to keep our site running smoothly, remember what's in your cart, and understand how you found us. You can control cookies through your browser settings, but blocking cookies may affect your ability to complete a purchase.
MINIMUM AGE
You must be at least 18 years old to make a purchase on myemberly.com. We do not knowingly collect personal information from anyone under the age of 13. If we discover that we have collected information from a child under 13, we will delete it.
INTERNATIONAL VISITORS
Emberly ships only within the United States. If you are visiting our site from outside the U.S., be aware that your information will be transferred to, stored, and processed in the United States, where our servers and offices are located.
CHANGES TO THIS POLICY
We may update this policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. When we do, we will update the "Last updated" date at the top of this page. We encourage you to review this page periodically.
